This data privacy policy applies for Neuzeit-Coaching, Irmgard Steuber, Sonnenhofstrasse 24b, 8853 Lachen ("Neuzeit-Coaching").

The protection of your privacy is important to Neuzeit-Coaching. We process your personal data according to applicable law.

We understand personal data to include all details and information that relate to a specific or identifiable person. This includes information such as names, telephone numbers, addresses or email addresses.

The objective of this data privacy policy is to inform you about the data that we process about you, to explain to you why we need this data and to show you how you can object to the collection of data. It is possible that other provisions regarding data protection or general terms and conditions and similar documents expressly regulate data processing in individual cases in addition or differently. Mentioning the processing of your personal data in this data privacy policy, includes handling of your personal data in general. In particular, this includes the collection, storage, use, processing, utilization, deletion, etc..

If you provide us with data of other persons (i.e. family-members, data of fellow workers) please make sure they took notice of this data privacy statement, and that you only provide us with the relevant personal data if you are authorized to do so and if the consent of that person has been obtained, and only, if this personal data is correct.

1      Why do we collect personal data?

We primarily process the personal data that we receive as part of our business relationship with our clients and other business partners from these and other persons involved or that we collect from their users when operating our website. All data processing is only carried out for specific purposes. These can arise, for example, from technical necessity, contractual requirements, legal regulations, predominant private or public interest or your express consent. First, we collect data in order to conclude and fulfill our contracts with our clients and business partners. Furthermore, your personal data may be required for the accurate conduction of our business, especially for the administration of client-relations, the provision of our services, invoicing, answering of questions and concerns, information about our services and their marketing.

In addition to that, we may use personal data from you and other persons as far as legally permitted or justified by contract and as it appears appropriate to us for the following purposes, in which we (and at times also third parties) have justified interest:

-        communication with third parties and processing of their requests;

-        collection of personal data from publicly available sources for acquisition purposes;

-        communication and marketing (including the realisation of events) unless you have objected to the use of your data for that purpose (you have a right to refuse when you receive marketing material as an existing customer – we will subsequently put you on a list and you will receive no further marketing material) ;

-        assertion of legal claims and defense in connection with legal disputes and official proceedings;

-        prevention and investigation of criminal offenses and other misconduct (e.g. carrying out internal investigations, data analyses to combat fraud);

-        maintain operations  of our business, particularly IT and our website;

-        Compliance with legal and regulatory obligations as well as internal regulations of Neuzeit-Coaching.

2      What sort of data is being collected?

For contractual reasons, we need personal information to provide our services in order to carry out the contractual obligations we have entered into and to be able to process our contracts. Such as, among others:

·       Names, gender , date of birth, information on reasons for the order (requested services provided by Neuzeit-Coaching)

·       Address, e-mail, phone number

Besides the data we receive from you, the personal data about you we obtain from third parties can be classified into the following categories:

·       information from public registers

·       data in connection with using the website (i.e. IP-address, MAC-address of your smartphone or computer, information about your device and settings, cookies, date and time of the visit, sites and contents retrieved, used functions, forwarded websites, location).

If you have given us your consent to process your personal data for certain purposes (for example by accepting cookies when visiting our website or voluntarily entering information via the contact form on our website), we process your personal data as part of and based on this consent, insofar as we have no other legal basis and such is needed. Given consent can be revoked at any time, which has no effect on data already processed by that point in time.

3      What sort of data is being processed when visiting our website?

You can generally visit our website on the internet without giving any personal data. For every visit of our website the server of our website-provider Jimdo GmbH, Stresemannstrasse 375, 22761 Hamburg, automatically collects the data your browser sends when a page is opened: the request, the IP-address, browser-type and -language and date and time of the request.

The information is used to analyze and maintain the technical operation of the server and the network as well as to combat abuse; it will automatically be deleted after 7 days. The processing of this data is based on the German General Data Protection Regulation (DSGVO) Art. 6 par. 1 lit. f of DSGVO resulting from the justified interest in the improvement of the stability and functionality of the websites of the website-provider. No other processing or transfer to third parties takes place. We do nevertheless reserve the right to have the server-logfiles checked retroactively, in case suspicion of illegal use of our website is justified. 

We use cookies with every visit of our website (as follows).

4      What are Cookies and when are they being used?

We use cookies and comparable technologies on our website in order to identify your browser or your device. Cookies are small files that are stored on your computer or mobile device when you visit or use our website. Cookies save certain settings via your browser and data about the exchange with the website via your browser. When a cookie is activated, an identification number will be assigned to it, which identifies your browser and so the information contained in the cookie can be used. 

By using our website, you agree with the use of these technologies. You can set your browser to giving you on-screen-warnings before saving a cookie. You can do without the advantages of personal cookies.  In that case certain services or functions cannot be used.

 

5      Tracking-Tools

Neuzeit-Coaching does not use webtracking-devices by Google Analytics or others.

 

6      Contact form

You have the option of using a contact-form to get in touch with us. Entering certain personal data is obligatory in that form (as indicated*):
We exclusively use those data (i.e. name, address, phone number, name of business) in order to respond to your enquiry in the best and most personal way.

 7      How long will your data be stored?

Your data will be deleted as soon they are no longer needed for fulfilling the purpose for which they were collected (e.g. for fulfilling a contractual relationship). It may be necessary to store data as long as possible claims can be asserted against Neuzeit-Coaching and insofar we have legal obligations or justified business interests (e.g. for matters of giving evidence or for documentation). Instead of deletion of data the data is locked if there are legal or actual obstacles to the deletion (e.g. statutory retention requirements).

8      Which rights do you have with regard to your personal data?

With regard to your personal data you have the following rights:

·       You can request information about your stored personal data.

·       You can demand correction, completion, locking or deletion of your personal data.

·       You are entitled to object to our data processing and to forwardig of certain personal data to other parties (data-portability). But please note that we reserve the right to assert the legally stipulated reservations on our part, for example if we are legally or contractually obliged to store or process certain data, have an overriding interest in it (insofar as we can refer to it) or we need it to assert claims.

·       You have the right to object to the use of your data for marketing purposes.

·       You can withdraw given consent at any time.

Please note that exercising of these rights may conflict with contractual agreements, which may have consequences for you, such as premature termination of the contract or monetary consequences (incurred costs). In this case, we would inform you in advance, as far as this is not already covered in the contract between you and Neuzeit-Coaching.

9      Obligatory personal data

As part of our contractual relationship we depend on you providing us with the personal data required for beginning and exercising our contractual relationship and the fulfilment of the related contractual obligations (you usually have no legal obligation for the provision of data). Without this data we will generally not be in the position to enter and fulfil a contract with you (or the position or person you represent or you are being represented by). Neither can our website be used without providing certain information required for the data-transfer (e.g. IP-address).

10    Will data be forwarded to third parties?

There will be no forwarding, sale or transfer of personal data to third parties unless this is necessary for the fulfilment of the contract or you have explicitly agreed to it.

11    Will your personal data be transferred abroad?

We are entitled to transfer your data to third parties abroad, within the scope of our business activities and the purposes according to section 1, as far as permitted and it appears appropriate to us (e.g. external service-providers like the data logging of the webside-provider – see sec. 3). Those parties are obliged to comply with data protection to the same extent as we are. If the level of data protection in a country does not correspond to the Swiss level, we contractually ensure that the protection of your personal data corresponds to that of Switzerland at all times. Alternatively, we can refer to the legal justification of the consent, the execution of the contract, the establishment, exercise or enforcement of legal claims, overriding public interests, the published personal data or because it is necessary for the protection of the integrity of the persons concerned.

12 Data-security

We use adequate technical and organisational security-measures to protect your stored personal data against manipulation, partial or complete loss and against unauthorised access by third parties. Our security-measures will continually be improved according to technical development.

Internal data protection is a serious concern. If we work with external service-providers (e.g. book-keeping) they will be obliged to confidentiality and to keeping up to the data-protection requirements.

We take reasonable precautionary measures to protect your data. But the transfer of information via internet or other electronic channels like e.g. messenger-services on your mobile phone always implies certain security risks. We therefore cannot grant for the security of data transferred on those channels.

13 Alterations to this privacy statement

We reserve the right to update and complement this Data Privacy Policy at our sole discretion. Please do regularly consult this statement.

 

NOTE: This Data Privacy Policy is a translation of the current German version. In the event of gaps, contradictions or questions of interpretation, the German version shall prevail.
